About these terms
These terms govern your use of easypoll.co.ke and the EasyPoll voting platform operated by Easy On Solutions, Eldoret, Kenya. By using the site or agreeing to a plan for the platform, you accept them. If your institution has a signed agreement with us, that agreement controls where the two differ.
The service
EasyPoll provides secure online elections for institutions: member registers, one-time-password verification, ballot creation, live results, certificates and an append-only audit trail. Features depend on the plan your institution holds. We may improve or change the service over time, and will not materially reduce what your institution has paid for without notice.
Accounts and access
Administrators are responsible for their sign-in credentials, for keeping member registers accurate, and for the roles they assign (registrar, results officer and so on). Tell us at once if you believe an administrator account has been compromised. We may suspend an account that we reasonably believe is being misused, and will tell the institution why.
Accepting use
You agree to use EasyPoll only for lawful elections your institution is entitled to run, and not to:
- impersonate another member or vote on someone else's behalf;
- interfere with the service, probe its security or overload its systems;
- reverse engineer it, resell it or copy it beyond what your agreement allows;
- upload malicious content or personal data you have no right to process.
Elections and results
Your institution is responsible for its own rules: who is eligible, how many candidates run, when voting opens and closes, and how disputes in its constitution are handled. EasyPoll records and counts votes as configured and keeps the audit trail behind the result. Where a result is contested, the audit trail and the institution's own rules - not our support team - determine the outcome.
Fees and payment
Fees follow the plan and invoice agreed with your institution. Unless stated otherwise, fees are in Kenyan shillings, invoiced in advance, and non-refundable once an election period has begun.
Availability
We run the service with reasonable care and aim to keep it available, but downtime for maintenance or events outside our control can happen. Institutions should plan election timing with a margin, and we will schedule maintenance outside announced voting windows where we can.
Ownership
Your institution keeps its member data and its election records. We keep the EasyPoll platform, its source code and its look. Each side keeps its own intellectual property; neither takes the other's.
Liability
To the extent the law allows, neither party is liable to the other for indirect or consequential loss, and our total liability arising from the service is limited to the fees paid for the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
Ending the relationship
Your institution may stop using the service at the end of its agreement term. We may end access for a serious or repeated breach of these terms. On ending, your institution may export its registers, results and audit records first; we delete remaining personal data according to the retention rules above.
Governing law
These terms are governed by the laws of Kenya, and its courts have jurisdiction. Questions, concerns or notices go to [email protected].
Changes
We may update these terms as the product or the law changes. Material changes affecting an institution on a paid plan will be notified before they take effect. Continued use after that means acceptance.
